Marine Arrested for Sexual Relationship with Minor in Albuquerque

Albuquerque – APD Detectives have arrested a United States Marine Corps enlisted personnel member while he was on leave here in Albuquerque. According to court documents, 20-year-old Derek Stanley had criminal sexual contact with a 13-year-old girl. The two met when Stanley was a senior in high school and she was in the 6th grade. Stanley stayed in contact with the minor while he was with the Marine Corps. Court documents state, the girl’s father called APD in reference to his daughter being sexually abused by Stanley. Detectives began building a case with interviews, digital recovery techniques, and search warrants to affected cell phone companies.

The criminal complaint states, that in May of 2022, Stanley and the girl met up on his military leave at a local ice skating where coerced sexual acts were committed by Stanley with the girl. APD detectives made an email acting like the victim to set up a meeting with the girl. On or around December 21st, 2022, Stanley was arrested by APD. A person enlisted in the military who commits criminal acts must notify their commanding officer and a significant offense such as this one will result in being dishonorably discharged from the military.

Stanley was released on pre-trial conditions while his case is pending. Here are the conditions:

– No contact with victim or witness

Shall not have contact with victim(s) or family(ies) of victim(s). ZERO TOLERANCE ON CONTACT WITH FV1 THIRD PARTY OR OTHERWISE

NO SOCIAL MEDIA WEBSITES. ZERO TOLERANCE ON THIS CONDITION. MUST RELINQUISH ANY SMARTPHONES OR DEVICES ABLE TO ACCESS SOCIAL MEDIA SITE TO FAMILY MEMBERS PRIOR TO RETURNING TO NORTH CAROLINA AND MUST PROVIDE AFFIDAVITS PRIOR TO LEAVING NM. MAY RESIDE IN NORTH CAROLINA SO LONG AS HE IS STILL ENROLLED IN MARINES. NO UNSUPERVISED CONTACT WITH MINORS UNDER 17. NOT PREMITTED TO USE ELECTRONICS OUTSIDE OF SCOPE OF EMPLOYMENT.

– Notify court, attorney & bondsman of change of address

– Will not possess firearms or dangerous weapons

MAY ONLY POSSESS FIREARMS OR DANGEROUS WEAPONS FOR WORK PURPOSES ONLY

– Release on personal recognizance.

– Maintain weekly contact with defense counsel

– Agree to medical, substance abuse or psychological treatment

MUST ENROLL IN SEX OFFENDER TREATMENT WITHIN 30 DAYS

– Not to Return to Location of Alleged Incident

– Not leave the defendant’s residence between the hours of ___
